This is a translation. The German version of these terms is the binding one. Where the two versions differ, the German version applies, except that as a consumer you may rely on the English version you were shown.
The service
Brauchma is a shared shopping list for families, run by Zwala, Waldviertel. Using it is free. You need a Google account to sign in. By signing in you accept these terms. The privacy policy explains how your data is handled.
Who can use Brauchma
You must be at least 14 years old to use Brauchma.
Acceptable use
Use Brauchma for what it is made for: shopping lists and organizing your household with your family. Do not:
- store content that is illegal or that infringes other people's rights,
- use invitations to send unwanted messages to people,
- try to access other people's accounts or families,
- disrupt the service, probe it for weaknesses or overload it, for example with automated requests.
You are responsible for what you write into Brauchma. Everyone in a family sees its list.
Your content
What you write into Brauchma stays yours. You allow the operator to store it, copy it into backups and show it to the members of your family, only as far as this is needed to run Brauchma.
Invitations
Invite only people you know and who would expect the invitation. When you invite someone by email address, you give Brauchma their address, and you are responsible for being allowed to do so. Everyone who joins a family sees its list.
Reports and moderation
Lists are visible only to the members of the family. The operator does not review content and acts only on reports or clear abuse.
To report illegal content, write to brauchma-support@googlegroups.com and say what the content is, where it is (the family and the item), and why you think it is illegal. A person reads every report, and you get an answer saying what was decided.
The operator may remove content that is illegal or breaks these terms, and may disable accounts for it. If that happens, the operator tells the person concerned which rule was broken, what was done and how to object. Objections go to the same address and are reviewed by a person.
Point of contact for authorities and users under the Digital Services Act (Regulation (EU) 2022/2065): brauchma-support@googlegroups.com, in German or English.
Closing accounts
You can delete your account at any time in the app under Settings. The operator may disable or delete accounts that break these terms or abuse the service, and in serious cases without notice. The operator then tells you why, as described under "Reports and moderation".
Voluntary contributions
Using Brauchma stays free. If you want, you can support Brauchma with a voluntary contribution, through a payment provider or by bank transfer; the app shows how under Settings → Support Brauchma. A contribution is not a payment for using Brauchma: it unlocks no features and creates no claim that Brauchma is available, offers a particular feature or answers support requests. "Availability, backups and the end of the service" and "Liability" apply unchanged.
As a thank-you, a family is shown as a supporter for one year from the day its contribution of at least €1 is received, and each further contribution adds a year: a small heart appears next to the family's name, its members can choose an accent colour, the family can vote in a roadmap poll when one is running, and the app pauses its support hint for that time. This recognition is a thank-you and may change or end with the service.
A contribution can also be given as a gift for another family, paid with a gift code: the family that redeems the code receives the year of recognition as if it had contributed itself on the day it redeems the code. A gift is voluntary like any contribution and creates no claims, neither for the person who pays nor for the family that redeems the code.
Contributions are not refunded, except where the payment provider refunds a payment under its own rules or where the law requires it. If a payment is refunded, the year of recognition it brought ends as well. The payment itself is handled by the provider under its own terms; the privacy policy explains what Brauchma stores about it.
Availability, backups and the end of the service
Brauchma is offered as is. The operator works to keep it running but does not guarantee that it is always available or free of errors, and may change features.
The operator makes an encrypted backup outside the server every 6 hours and deletes each backup after 30 days, so a failure of the server can mean that the changes since the last backup are lost. These backups serve to restore the whole service after a failure, not single items or lists on request. Keep your own copy of anything you cannot afford to lose.
The operator may end the service. It announces this on this website at least 60 days before the service ends.
Liability
Brauchma is free and comes without warranty, as far as the law allows. The operator is not liable for slight negligence. This does not limit liability for intent or gross negligence, for personal injury, or where the law does not allow a limitation.
Applicable law
Austrian law applies, without its conflict-of-law rules and without the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection of the country where you live stays in force.
Changes to these terms
If these terms change, the new version is published here with a new date. The operator announces changes on this website at least 30 days before they take effect. If you keep using Brauchma after that date, the new terms apply. If you do not agree with them, you can delete your account before then.
